The Terms of Service comprise the entire agreement between you and expcopyprint.com and supersedes all prior agreements between the parties regarding the subject matter contained herein. BY OPENING AN ACCOUNT WITH www.expcopyprint.com OR USING www.expcopyprint.com, CUSTOMER AGREES TO BE BOUND BY THE TERMS AND CONDITIONS AT ALL TIMES
You are granted a restricted license to access and use this Website and Site Content solely for the purpose of evaluating the product and service offerings on the Website and making orders for ExpCopyPrint products and services through this Website. By implication, estoppel, or otherwise, you are not granted any rights or license in or under a patent, trademark, copyright, or other intellectual rights of ExpCopyPrint or any third party. Without ExpCopyPrint prior written consent, you may not use any meta-tags or other "hidden text" containing ExpCopyPrint name or trademarks.
You may elect to electronically upload or otherwise submit data, text, pictures, images, messages, or other materials (collectively, "Customer Content") to ExpCopyPrint to print and service offerings. You acknowledge and agree that any Customer Content is completely your responsibility (and that of any other person from whom it may have originated).
When you upload or otherwise provide Customer Content to ExpCopyPrint, you warrant and confirm that you own or have permission to copy any documents, text, graphics, photographs, or other items you submit for inclusion in the print process, and you agree to defend, indemnify, and hold ExpCopyPrint and its officers, directors, employees, and affiliates harmless from any suit, demand, or claim arising out of any breach of this warranty and agreement.
ExpCopyPrint will not take any responsibility for your uploaded documents and other things that you provided us virtually or physically.
You can cancel your order any time before assigning job status. If you cancel your order before it is assigned a Job Status, a Customer Service representative from ExpCopyPrint will notify you of any cancellation fees (any refunds will be credited to your account after at least 10 business days). Once a print order has Job Status or has gone through any process, it cannot be canceled, and no refund will be granted.
Customer shall maintain the security and confidentiality of the login ID and password. Customers may change the password or any other account information at any time by logging in to customer's account at expcopyprint.com.
Except in the following situations, we never share any user information collected through the Site to other parties:
To Service Providers: Sometimes, we may disclose your information (on a confidential basis) to service providers and others that we employ in the regular operation of the Site. Examples include account and billing, payment card processing, user experience research and surveys, website hosting, support, and maintenance. Additionally, we reserve the right to share your personal information with companies like Google that help us market and advertise. Although these service providers might have access to the personal data required to deliver their services, they typically are not allowed to share or use non-aggregated personal data for any other function.
With your permission: When you give us permission, we will share your personal information with other businesses, groups, or people.
For legal purposes: We may disclose user information to third parties when we have a good-faith belief that such action is necessary to:
conform to any applicable law, regulation, legal process, or enforceable governmental request; or
protect against harm to our rights, property, or safety, or the rights, property or safety of our users or the public, as required or permitted by law.
Business Transfer: In the event of a business transfer, we may disclose your information. We might merge with or be bought out by another company, just like any other company, or we might seek bankruptcy protection in the future. In this situation, all user data we have collected and kept about you, including personal data, will be transferred to a new company in the case of a corporate merger, consolidation, asset sale, bankruptcy, or other corporate change. Prior to any such transfer, the Privacy Policy (as it stood on the date of submission) would continue to apply to any user information supplied. However, a new privacy policy adopted by a successor entity may apply to user information provided after a transfer to that entity.
The prints from ExpCopyPrint we follow CMYK industry standards. We are unable to guarantee "match-print" color fidelity or eliminate small color changes during an order. We cannot guarantee that the final print color will perfectly match any preview as it appears on your monitor because we have no control over the color reproduction of a customer's computer monitor. Any color shift in converted photographs (RGB images) with black, nearly black, or gray tones is not ExpCopyPrint's fault. Before submitting the file, color shifts from a perceived black or gray must be addressed. Proofs do not assure a final product that is black, nearly black, or gray. Please be aware that the UV coating application may affect or alter the appearance of printed colors. A UV coated product's final color look is not up to ExpCopyPrint's control.
ExpCopyPrint occasionally runs promotions and exclusive deals that are denoted by Coupon Codes. Each coupon code will have unique conditions and benefits. Normally, the Coupon Code will be sent to you through email or a coupon. Read the terms and conditions carefully if you receive a coupon or email that includes a coupon code since you must comply with them in order to benefit from the promotion or special offer. Unless otherwise specified, all Coupon Codes are only valid for a single transaction and are only available to active customers of ExpCopyPrint with a valid account.
When placing an order, put the Coupon Code in the relevant field to take advantage of a promotion or special offer. Promotions and special deals do not apply to all goods. If a Coupon Code is entered but does not work, the product in question does not meet the requirements for the promotion or special offer; the decision is final.
A coupon code cannot be used in together with any other ExpCopyPrint promotions, special discounts, offers, or rewards. You are not permitted to input another Coupon Code or use any other promotion, special offer, discount, or reward after using a Coupon Code or taking advantage of a promotion, special offer, discount, or reward.
Coupon Codes are only valid for purchases made through the ExpCopyPrint website; they cannot be applied to the purchase of goods from affiliates of ExpCopyPrint or from websites that are linked to any current ExpCopyPrint website, or goods sold by or under the brands of third parties. Taxes, shipping, and other fees cannot be covered by coupon codes. Taxes, shipping and handling fees, and other costs do not count toward the minimum purchase amount if the promotion or special offer has one.
If a promotion or special offer is for a set amount (like $10.00 off) and applies to a multi-item order (like multiple sets of presentation folders), it will be divided among all eligible items according to their relative values, excluding shipping and handling, taxes, and other fees. It's possible that a few items won't count toward the calculation and won't be eligible for the offer.
Promotions and limited-time offers are only available while products remain. They will end on the day or during the window of time that the offer specifies. A promotion or special offer is effective until the end of the month in which the Coupon Code is first eligible for use, unless a different date or timeframe is mentioned.
Coupon Codes (and the Coupons or emails that include them) are not for resale, have no separate cash value, cannot be redeemed for cash, and will not be replaced in the event that they are lost, stolen, or deleted.
Coupon Codes cannot be used to modify orders that have already been placed with ExpCopyPrint.
Subject to the conditions of our Returns/Refund/Reprint Policy, you will only receive the amount actually paid in the event that a Coupon Code is used and the entire order is cancelled, rejected, or if you return all items in the order. The promotional code will expire.
Subject to the conditions of our Returns/Refund/Reprint Policy, the applicable discount or promotion will be applied to the item(s) that are kept if only a portion of your order is canceled or rejected, or if you only return some of the items in your order. Despite the, a promotion or special offer of any kind will never be used to establish a credit balance. The promotion or special offer will be applied to the remaining amount (excluding shipping and handling, taxes, and other fees) of an order that has been partially canceled, rejected, or returned if the remaining balance is less than the value of the promotion or special offer. The Coupon Code will no longer be valid, and the remaining portion of the promotion or special offer is null and invalid.
A promotion, special offer, or discount may be canceled at any moment with immediate effect by ExpCopyPrint.
Without reference to any application of conflict of law principles, the laws of the State of New York shall govern the Site Terms and your use of this website. Regardless of where you access this website, you agree that any legal or equitable proceedings arising out of or related to these Site Terms and/or your use of this Website must be brought before a federal or state court in New York, New York, and you hereby irrevocably and unconditionally consent to and submit to the exclusive jurisdiction and venue of such courts over any suit, action, or proceeding arising out of or under these Site Terms and/or your use of this Website. The application of the United Nations Convention of Contracts for the International Sale of Goods, which is expressly excluded, is not applicable to this Agreement.
You consent to indemnify, defend, and hold harmless ExpCopyPrint and its officers, directors, employees, shareholders, agents, affiliates, subsidiaries, suppliers, and representatives from and against any and all claims, damages, losses, costs, and expenses (including but not limited to attorneys' fees) that arise out of or are related to any of the following, whether directly or indirectly: (i) any violation of the Site Terms by you; (ii) any lawsuit, claim, or demand resulting from or relating to a claim that any Customer Content provided by You, or any other text, photograph, image, graphic, or other material you incorporated into products or services ordered from this ExpCopyPrint, that was not a component of the standard Site Contents, infringes the rights of a third party; (iii) and/or (c) any actions you take in connection with this website, how you use it, and/or any goods or services you order from it.
You may choose to electronically upload or otherwise submit data, text, images, graphics, messages, or other items (collectively, "Customer Content") to ExpCopyPrint for inclusion in print products for a selection of product and service offerings. You agree that any Customer Content is exclusively your responsibility (together with any other person(s) from whom it may have originated). When you upload or otherwise give ExpCopyPrint customer content, you certify and guarantee that you either have the right to use any text, graphics, photographs, or other materials you submit for inclusion in the printing process or have permission to do so. Additionally, you agree to defend, indemnify, and hold ExpCopyPrint, its officers, directors, employees, shareholders, agents, and affiliates harmless from any suit, demand, or claim resulting from any violation of this warranty.
Customer Content is not continuously kept up by ExpCopyPrint. Customer Content that is uploaded to the Website and related to an order is stored for a minimum of thirty (30) days. It might be deleted and unrecoverable at the end of that period.
You acknowledge and agree that you will not send, upload, post, or otherwise make available to ExpCopyPrint any Customer Content that (i) is unlawful, threatening, abusive, defamatory, or obscene; (ii) invades another person's privacy; (iii) would help to commit or cover up a crime; (iv) encourages or advocates treason, insurrection, sedition, or forcible resistance to any law of the United States; (v) is not lawfully yours to transmit; (vi) is the subject of, or which infringes upon, any patent, trademark, trade name, trade secret, copyright, right of publicity, moral right or other intellectual property right of another person or entity; (vii) contains software viruses, trojans, malware, or other harmful or malicious computer code, or that in any other way would way interfere with or disrupt the services and/or production of ExpCopyPrint and/or or any servers or networks connected to or used in connection with the delivery of such service and production.
You acknowledge that ExpCopyPrint does not pre-screen Customer Content, but that ExpCopyPrint reserves the right to do so at any time and that ExpCopyPrint and its affiliates shall have the right (but not the obligation) in their sole discretion to remove any Customer Content and/or to refuse to fulfill a print job or order that violates these Site Terms or that may otherwise be objectionable. You further acknowledge and agree that ExpCopyPrint may preserve Customer Content and may also disclose Customer Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Site Terms; (c) respond to claims that the Customer Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of ExpCopyPrint, its employees, users and the public in general. ExpCopyPrint retains all of its rights in and to all Site Content on this Website, whether developed by, for, or on behalf of ExpCopyPrint, regardless of whether Customer Content is uploaded to this Website or included in any products or services supplied through this Website.
expcopyprint.com will use commercially reasonable best efforts to prevent any fraudulent use of the expcopyprint.com service. ExpCopyPrint works diligently to prevent credit card fraud and cancels any Member accounts engaged in such activity and returns the merchandise to the merchant. Customer agrees to provide documents to insure against fraud, such as copies of identification and credit cards, purchase evidence, order confirmation, etc. The customer also agrees not to use the expcopyprint.com service for multi-level marketing, pyramid schemes, receiving checks and/or money orders, and other business practices easily subject to abuse.
If any account is suspected of illegal or fraud use, expcopyprint.com may proceed to immediately terminate these Terms of Service and reserves the right to hold all packages of that account up to 3 months. After 3 months, expcopyprint.com reserves the right to return these packages and charge the return fee or destroy these packages.
